Oak Bay father's appeal in Christmas Day murders to begin Monday

The B.C. Court of Appeal will begin hearing evidence Monday in an Oak Bay father’s bid to overturn his convictions for the murders of his two young daughters on Christmas Day 2017.

The B.C. Court of Appeal will begin hearing evidence Monday in an Oak Bay father’s bid to overturn his convictions for the murders of his two young daughters on Christmas Day 2017.

In September 2019, Andrew Berry was convicted of the second-degree murders of six-year-old Chloe Elizabeth and four-year-old Aubrey Kate, who were stabbed to death at his Beach Drive apartment. In December 2019, he was sentenced to life in prison with no eligibility of parole for 22 years.

Berry, who maintains his innocence, filed the notice of appeal minutes after his sentence was imposed. He is also appealing the length of his parole ineligibility.

The hearing, which is scheduled for four days, will take place at the Vancouver Law Courts.

The Court of Appeal has also arranged for the hearing to be broadcast live in a Victoria courtroom “given the level of interest from media and members of the public,” says a notice on its website.
