Leaving windows open not against the law

Re: "Woman stunned to get ticket for leaving car windows open," Sept. 27.

There is nothing in B.C.'s Motor Vehicle Act that states a vehicle's doors must be locked or the windows closed. The act does not address doors or windows. It addresses locks and devices.

Section 191 (1) states a vehicle must be equipped with a lock or device to prevent unauthorized use of the motor vehicle and section 191 (2) (a) states a driver must not permit a motor vehicle to stand unattended or parked unless the driver has locked it or made it secure in a manner that prevents its unauthorized use.

If the ignition is switched off in a locked position and the ignition key is removed, the vehicle is in a locked and secure state that prevents unauthorized use. And I seriously doubt that could be successfully argued against in a court of law.
