Trial of escaped inmates accused of killing Metchosin man adjourned after injury

The trial of two men accused of killing a Metchosin man three years ago was adjourned Tuesday morning after one of the two was injured.

Zachary Armitage and James Lee Busch are charged with killing 60-year-old Martin Payne in July 2019, the day after they escaped from William Head prison. Both have pleaded not guilty to the crime, and their trial began Monday in B.C. Supreme Court in Vancouver.

On Tuesday, Justice David Crossin excused the jury, telling them that Armitage had suffered what appeared to be a back injury.

“I’m satisfied that it’s serious enough he is unable to get to court,” said Crossin. “We’re going to make some inquiries during the day to see how things are progressing for him.”

The jury has been asked to return to court Wednesday morning.
