Former employee is suing Town of Sidney for wrongful dismissal

Sidney’s former manager of information services is suing the town for wrongful dismissal.

Peter Payerl alleges in a notice of claim filed in B.C. Supreme Court that the town “fabricated” a reason to fire him last month in order to avoid paying severance.

“In doing so, the [town] acted in a reprehensible manner worthy of rebuke,” the claim says.

Sidney has yet to file a statement of defence, and Payerl’s claim does not reveal what reasons the town gave for dismissing him.

Sidney’s chief administrative officer Randy Humble declined to comment Monday, saying it was a personnel matter that is now before the courts.

Victoria lawyer Darren Williams, who represents Payerl, also declined to comment.

The claim says Payerl was hired as manager of information services in 2001 and “diligently and faithfully completed his duties under his employment contract” until he was terminated without cause on June 18.

The claim says that at no time did the town discipline Payerl, give him an opportunity to correct his alleged incorrect behaviour or warn him that he was in danger of being fired.

The claim says that under the terms of his contract Payerl is entitled to 18 months’ salary, plus benefits, employer pension contributions and vacation time.

Payerl was earning about $105,000 a year at the time of his dismissal.

The claim says Payerl also is owed banked vacation and discretionary leave and sick time.

He is seeking damages for wrongful dismissal, court costs and other penalties against the town of Sidney.

“The defendant acted in a high-handed and reprehensible manner worthy of rebuke and is liable for punitive or exemplary damages,” the claim says.
