The harmonized sales tax claimed the first Brannigans restaurant, and now it seems another tax has done in the second location.
The doors at Brannigans on Cedar Hill Cross Road have been closed and a bailiff's notice says the restaurant has been seized and assets will be sold to cover a judgment and costs under the Excise Tax Act.
According to court documents, the 110-seat Brannigans owes almost $65,000 to the Canada Revenue Agency.
Comox Valley Bailiffs will conduct a sale of the assets through West Coast Liquidators on Thursday from 10 a.m. until 3 p.m. to recover the costs.
The sale will be at the restaurant, unit 216 at 1551 Cedar Hill Cross Rd.
John Bradshaw, owner of Comox Valley Bailiffs, citing confidentiality, would not provide details on what will happen if the sale does not covers costs, but did confirm the sale will go ahead this week. Available in the sale is restaurant gear such as a walk-in cooler, convection oven, deep fryers, gas griddle, coolers, chairs, tables and the like.
Attempts to contact Patrick Wood, whose family bought the restaurants in 2007, were unsuccessful.
In January 2011, Wood told the Times Colonist the HST, which hit restaurants hard by adding seven per cent to the cost of restaurant meals, forced the family to close the Brannigans on Maple Street near the Accent Inn.
"We decided to consolidate because of the economy and the HST," Wood said at the time, estimating that between the HST's introduction on July 1, 2010, and the end of that year, the restaurants saw a 13 per cent decrease in sales.
The Maple Street Brannigans closed its doors Dec. 29, 2010. The last Brannigans was at the location where the O'Donals chain of restaurants, started more than 30 years ago, got its start.
