The Independent Investigations Office had to determine whether the officer used excessive force when he kneed the man in the shoulder and head area and whether this caused a facial fracture which required surgery.

The Independent Investigations Office is asking to hear from any witnesses to a Feb. 16 arrest in downtown Victoria, on the wharf in front of the Red Fish Blue Fish food stand.

The IIO, a civilian-oversight agency that investigates police-related incidents resulting in serious harm or death, said the arrest by Victoria police officers happened about 10 p.m.

Two males were arrested, but one resisted and a struggle ensued.

He sustained an injury that has prompted the IIO to get involved.

The IIO said it would particularly like to hear from a person who assisted officers during the incident.
