I vote with the judges - Nick Clew-ley's submission says it all. Many condominium owners would be pleased if they could put their thoughts forward on the subject of smoke intrusion with the same clarity of thought.
A tenant who lives above a smoker may eventually be forced to move, but how is a suite or unit owner to deal with this, as no prospective buyer other than another smoker would even make an offer?
Tribunals, judges and strata councils should keep a copy of Clewley's work at hand.
Not been there, but am there.
