An ex-employee at a restaurant formerly managed by Duncan Morrison filed a fraud complaint with Victoria police Saturday, saying the restaurateur has not paid him or others for their work.
Beric Ofori took paperwork and documents to the police station that, he said, support his claim that Morrison either didn't pay, or wrote cheques that bounced, for him and others at the Wharfside Seafood Grille.
Ofori said he feels the only recourse left is to ask the police to investigate, after trying various other agencies to try to deal with situation.
"It's very frustrating," said the 26-year-old line cook, who said he is owed $3,000 for unpaid work. "It's about time the little people have their rights too, not just the rich people."
Ofori said he's had bounced cheques and many hours of unpaid overtime. Working 90 hours a week at the 1208 Wharf St. restaurant wasn't uncommon, he said.
Over the past 17 years, more than 110 complaints have gone to B.C.'s employment standards branch in connection with various companies involving Morrison in either ownership or management roles.
The latest are from the Wharfside Seafood Grille. Twenty complaints have been filed to B.C.'s employment standards branch from former staff who said they had not been paid for work they had done.
Of the complaints relating to Wharfside, 10 are outstanding and investigations into the complaints are underway.
"How can people just be allowed to do this?" said Ofori, who expects others will also go to the police as well.
Staff Sgt. Darren Laur said the complaint will be forwarded to the fraud division Monday for investigation.
A complaint does not mean a person will be charged.
An "Occupy Wharfside" Facebook page has gone from 14 members to more than 170, Ofori said. He's met people who have complaints dating back 15 years.
The majority of people living in Victoria "are not rich. They need to work for a living and they need to count on being paid," Ofori said.
In an interview last week, Morrison said he is no longer running the restaurant and he is moving to Calgary for a "clean, fresh start."
The company 0762736 B.C. Ltd., which does business as the Wharfside Eatery, lists its director as Maria-Jose Hernandez, with a mailing address of 1208 Wharf St., the address of the restaurant. Its most recent annual report was filed in July 2010. Hernandez is the former wife of Morrison.
