Judge reserves decision on Victoria bid to remove boats, docks from Gorge

B.C. Supreme Court Justice Peter Voith has reserved his decision after a hearing into the City of Victoria’s bid for an injunction to remove 17 boats and four docks from a section of the Gorge Waterway.

B.C. Supreme Court Justice Peter Voith has reserved his decision after a hearing into the City of Victoria’s bid for an injunction to remove 17 boats and four docks from a section of the Gorge Waterway.

The hearing ran for two-and-a-half days, with city lawyer Tom Zworski saying a municipal bylaw should decide the issue. Brian O’Reilly, a lawyer for one of the boat owners, countered that navigation and shipping come under federal control.

Victoria passed a bylaw in 2016 limiting moorage in the Gorge to 48 hours in one spot, and to 72 hours in one spot over 30 days.

The area in question is north of the Selkirk Trestle and adjacent to Banfield Park.
